Au cours des dernières années, on a observé une recrudescence de vols de véhicules, lesquels contribueraient notamment à un réseau de trafic international. En 2024, le gouvernement du Canada a tenu un sommet national sur la question. À la suite de cet événement, le Comité permanent de la sécurité publique et nationale a publié le rapport intitulé « Lutter contre le phénomène des vols de véhicules au Canada », dans lequel plusieurs témoins soulèvent l’importance d’accroître la sécurité des véhicules.
Dans cette action collective, le requérant reproche aux défenderesses, soit les constructeurs d’automobiles ci-dessous mentionnés, de fabriquer, importer, vendre et louer des véhicules qu’elles savent vulnérables au vol en raison d’un défaut de conception des clés intelligentes dont sont munis ces véhicules. Le requérant reproche également aux défenderesses leur défaut d’information relativement à la faille de sécurité du système d’accès et de démarrage avec la clé intelligente. De ce fait, elles contreviendraient aux dispositions de la Loi sur la protection du consommateur.

In recent years, there has been a resurgence in vehicle thefts, which are believed to be linked in part to an international trafficking network. In 2024, the Government of Canada held a national summit on the issue. Following this event, the Standing Committee on Public Safety and National Security published a report entitled “Combating Auto Theft in Canada”, in which several witnesses highlighted the importance of enhancing vehicle security.
In this class action, the plaintiff alleges that the defendant companies—namely, the automobile manufacturers listed below—manufacture, import, sell, and lease vehicles that they know are vulnerable to theft due to a design flaw in the smart keys with which the vehicles are equipped. The plaintiff also accuses the defendants of failing to inform consumers about the security vulnerability in the keyless entry and start system. As such, they are said to be in violation of the provisions of the Consumer Protection Act.

The group members are defined as follows:
"Any natural person, considered a consumer within the meaning of the Consumer Protection Act, domiciled or residing in Quebec, who has been the victim of the theft of one or more vehicles, as of May 2, 2021, equipped with a keyless entry and start system using a personal electronic key fob (excluding those equipped with Ultra-Wide Band technology), and manufactured or imported and marketed in Quebec by one of the defendants."
